OpenRoad values your privacy and does not sell your personal information. Our collection and use of personal information is limited to the standards outlined in this Privacy Policy. This Privacy Policy describes how Open Road Insurance LLC (the "Site", "we", "us", or "our", or OpenRoad) collects, uses, and discloses your personal information when you visit, use our services, quote insurance, or make a policy transaction on (the "Site") or otherwise communicate with us (collectively, the "Services"). For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a website visitor, policyholder, or another individual whose information we have collected pursuant to this Privacy Policy.

  • Any and all other information you submit to us directly. This may include information you have provided in surveys, polls, questionnaires, social media or similar channels. This also includes any information we may collect as permitted or required by law.

Some features or the Services may require you to provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features.

Information We Obtain from Third Parties: We may also obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices.

  • Companies who support our Site and Services, such as HubSpot.
  • Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to complete your transactions with us and provide you with products or services you have requested, in order to perform our contract with you.
  • When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

  • Driving records about you, other people listed as policyholders, other drivers, and/or other household members.
  • Insurance claim history for you, other policyholders, drivers, or household members.
  • Information about your other vehicles listed within your household.

Information We Collect through Cookies: Like many companies, we use cookies, pixels and similar technologies ("Cookies") on our website. We also automatically collect certain information about your interaction with the Services ("Usage Data").  Usage Data may include information about how you access and use our Site and your account, including device information, browser information, information about your network connection, your IP address and other information regarding your interaction with the Services. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interactions with the Services (in our legitimate interests to administer, improve and optimize the Services). Providing Products and Services: We use your personal information to provide you with various Services in order to perform our contract with you, including to process your payments, completing your insurance transactions, to send you notifications related to your policy or other transactions, to create, maintain and otherwise manage your policy and account, and to enable you to post reviews. This can also include: Completing, issuing, renewing and servicing your insurance policy.

  • Improving our customer service processes and digital properties such as our website and account management tools.
  • Determining your insurance needs.
  • Maintaining our business records for reasonable periods as well as the general management and administration our business.
  • Keeping your policy and account information accurate and up-to-date.
  • Other product servicing uses as permitted or required by law.

Security and Fraud Prevention: If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other account access or policy details with anyone else. If you believe your account has been compromised, please contact us immediately. We may use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. This can include:

  • Analyzing various business trends.

OpenRoad will disclose information with the following categories of third parties as necessary:

  • Our underwriting companies as well as your broker or agent. Most of the information collected about you and described within this privacy policy will be disclosed to our underwriting company as well as your broker or agent for the purposes of evaluating, issuing, renewing and servicing your insurance policy with OpenRoad.
  • As required to various regulatory and self-regulatory agencies.
  • Consumer reporting agencies.
  • Licensed insurance agents and/or brokerages that have referred you to OpenRoad.
  • Legally obligated disclosers such as law enforcement, attorneys, or lawsuit parties due to court subpoenas or laws.
  • Insurance adjusters or insurance companies for use in claims handling.
  • Advertising and marketing service providers contracted by OpenRoad.
  • Third party professional service providers contracted by Open Road.
  • Research consultants, analytics service contractors, and data brokers/providers.

Our Site may provide links to websites or other online platforms operated by our partners or third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies as well as other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Our use of personal information: The personal information we collect about you includes information within the data categories mentioned in the Notice of Disclosure for California Residents (link provided below). These data categories also represent the personal information we have collected over the past 12-month period. Please note the categories referenced in the Notice of Disclosure for California Residents refers to the categories of personal information as defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, Cal. Civ. Code § 1798.100 et seq., (“CCPA”) and other laws implementing or supplementing the CCPA. If a data category is included, this indicates that depending on the services and products we provide to you, we may collect some information that falls within that category. It does not indicate that we collect all information listed in a category for all policyholders, prospects, or site visitors. It also does not necessarily mean that the CCPA applies to that specific data category for all policyholders, prospects, or site visitors (i.e., if the data category is governed by the federal Gramm Leach Bliley Act or the Fair Credit Reporting Act).

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address, account details, or policy information before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.
